Family Medical Leave Act (FMLA)

The Federal Family Medical Leave Act (FMLA) allows eligible employees to take up to 12 weeks of unpaid, job-protected leave in a 12-month period.  Here is a link to the US Dept. of Labor FMLA Employee Rights which explains leave entitlements, benefits & projections, eligibility requirements, info on requesting leave, the employers responsibilities and enforcement.  It is important to note, Pursuant to Conn. Gen. Stat. 31-51rr(a)(2), school paraprofessionals in an education setting who have worked only 950 hours are entitled to the same FMLA rights as those who meet the 1,250 hour requirement.

Family First Coronavirus Response Act (FFCRA)

The FFCRA requires employers to provide paid leave through two separate provisions:
  1. the Emergency Paid Sick Leave Act (EPSLA), which entitles workers to up to 80 hours of paid sick time when they are unable to work for certain reasons related to COVID-19, and
  2. the Emergency Family and Medical Leave Expansion Act (EFMLEA), which entitles workers to certain paid family and medical leave.
It's important to stress, there are specific COVID-19 related qualifying reasons which allow you to use EPSLA and EFMLEA time.  All qualifying reasons can be found in the Employee Rights Poster link below.

The FFCRA's paid leave provisions were effective on April 1, 2020 and applies to leave taken between April 1, 2020 and December 31, 2020, see the posters below.
